Explore App Costa Rica - Terms & Conditions

The following are the Terms and Conditions of Use of Explore App. Any user or tourism establishment that wishes to be part of the platform must be in full agreement with them.


Definitions

 

For the purposes of our Terms and Conditions of Use:


Account means a unique account created for you to access our Service or parts of our Service.


Application means the software program provided by the Company downloaded by You on any electronic device, called the Explore App.


Company (referred to as "the Company", "We", "Us" or "Our" in this Agreement) refers to Improve Apps Sociedad Anónima.


Country refers to: Costa Rica.


Device means any device that can access the Service, such as a cell phone or digital tablet.


Service refers to the Application.

Virus refers to a malicious software program loaded onto a user's computer without the user's knowledge and performs malicious actions.

Tourist establishment refers to any of the tourist businesses registered on our platform.

Promotion or Offer refers to any type of promotion of a tour, product or service, that is offered by a tourist establishment that is registered in our platform, in our Promotions section.


You mean the person who accesses or uses the Service, or the company or other legal entity on whose behalf that person accesses or uses the Service, as applicable.

Service Description

 

Explore is an Application that has the goal of encouraging tourism in Costa Rica through a platform that offers various tools so that users can find national parks, tourist establishments and different types of tours to go out and enjoy nature in the country.

 

Cost of service

 

The service is free, this means that any tourist establishment that registers in the system does not have to pay to be part of it. In addition, the download and use of the Application is also free for any user. 

The promotions service is also free, this means that a tourist establishment that is part of the platform don't need to pay to publish a promotion in the platform. 

 

On the other hand, we reserve the right for the model and cost of the service to change or to include in the Application any type of functionality for which a monetary payment is required or that generates profits for the company, at any time.

 

It should be noted that in the event that any type of functionality or service that requires payment from users or tourist establishments of the Application is changed or included, this will be previously communicated, and clearly users and establishments will be able to choose whether to purchase the service or whether to pay the required functionality. No automatic or sudden charges will be made in the Application, it is important to note that we do not have payment data for any user or tourist establishment.

 

Register Your Business in the Application

 

Tourist establishments that wish to be part of the Application can contact us by email (info.explorecr@gmail.com), WhatsApp (+506 89478868) or register in the form available on our website (https://www.improveappscr.com/explore-app). It is important to emphasize that we take care of reviewing any application for registration to the Application in advance and we reserve the right to accept or reject the registration of any tourist establishment at our sole discretion.

Register a Promotion in the Application

 

All tourist establishments registered in our platform will have the option to publish an offer or promotion in our Promotions section. For doing this, they can contact us by email (info.explorecr@gmail.com) or WhatsApp (+506 89478868). We will let them know the requirements for the publication and the info we need as well. We reserve the right to accept or reject any offer or promotion proposed by an establishment  at our sole discretion.

 

Request Your Business Removal from the Application

 

Any tourist establishment that is part of the Application may request to be removed from it at any time. For this, you can contact us by email (info.explorecr@gmail.com) or WhatsApp (+506 89478868) and we will start the process to remove the establishment of the application. You will find links to our email and WhatsApp in our app, specifically in the section "Contact us"

 

If the tourist establishment later wishes to join the application, it can do so by following the steps described in "Register your business in the application".

Request Removal of Promotion/Offer from the Application

 

Any tourist establishment that is part of the Application and has a promotion or offer published with us, may request the removal of the promotion or offer at any time. For this, you can contact us by email (info.explorecr@gmail.com) or WhatsApp (+506 89478868) and we will start the process to remove the promotion or offer from the application. You will find links to our email and WhatsApp in our app, specifically in the section "Contact us".

Request User Account and Data Removal from the Application

 

Any regular user that is part of the Application and had logged in can request to be removed from the platform at any time. For this, you can contact us via email (info.explorecr@gmail.com) or WhatsApp (+506 89478868). You will find links to our email and WhatsApp in our app, specifically in the section "Contact us". Once you contact us and inform about your desire to delete all your data, we will start the process to remove it and let you know when it's done.

 

Is important to mention that he data we save in our database from users is minimal, mainly login basic data (in case you decide to log in the system) like: name, email, profile picture and your favorite destinations data. 

 

We also offer the option "Delete Account" directly in the app. To access this option you can go to the Settings screen in the app and select the Delete Account option at the bottom.

You can re-join our platform by installing our app again.

 

Update your Business Data

 

Any tourist establishment that is part of the application can request an update of its data at any time. For this, you can contact us by email (info.explorecr@gmail.com) or WhatsApp (+506 89478868) and we will start the process to update the information of the establishment.

 

License to Use

 

Subject to your acceptance and compliance with the terms of this Agreement, we grant you a non-exclusive, non-transferable, non-shareable, revocable and limited license to use the application / services solely for your personal, non-commercial use in accordance with this Agreement.

 

Prohibited Conduct

 

Is prohibited:

 

- Execute any conduct of harassment, threat, intimidation, predation or stalking either for tourist establishments, other users or the company that provides the service.

 

- Use the account of another User without authorization.

 

- Use the Application in a way that may interfere, inhibit or negatively affect other users, tourist establishments or the company that provides the service.

 

- Interfere or attempt with the service in any way. For example introducing a virus, network overload or some similar behavior that affects the service.

 

- Reverse engineer, decompile or disassemble any aspect of the Application or do anything that may discover the source code or circumvent the measures used to limit access to any part of the Application.

 

- Develop or use any third-party application that interacts with the Application, without prior written consent, including scripts designed to extract information from the Application.

 

Right to Terminate Accounts

 

If you breach any of these Terms and Conditions of Use or if we consider that a user or tourist establishment has a behavior that harms our company or service, we reserve the right, at our sole discretion, to remove the tourist establishment from the Application or to terminate its right of access or use of the same. We are not responsible for any loss, damage or injury related to your inability to access or use the Application based on such termination.

 

Canceling or Deleting an Account

 

Any user can request that their account be completely eliminated from the application at any time, for this they must contact us by email (info.explorecr@gmail.com) or WhatsApp (+506 89478868), and we will immediately carry out the cancellation of the account.

We also offer the option "Delete Account" directly in the app. To access this option you can go to the Settings screen in the app and select the Delete Account option at the bottom.

 

If this happens, the user may re-create an account and enter the application at any time using the registration means provided by the Application.

 

Content Ownership

 

All content that is related with Explore branding and displayed in the application or website is owned by our Company.

 

The photographs and information of each private tourist establishment is provided by their owners or representatives.

 

Photographs and information of national parks or public tourist places are provided by our company. The content is investigated and collected through the internet or through direct contact with representatives of the establishments. Some photos are provided free of charge by people who wanted to collaborate with the project and the photo credit is added both on our website and in the Application.

 

We undertake to remove from the Application any content that we are told is infringing copyright and for which we are not aware that it was violating them. To inform us of any infringement, you can contact us by email (info.explorecr@gmail.com) or WhatsApp (+506 89478868).

 

Right to Update or Modify Terms


We reserve the right, at our discretion, to update our Terms and Conditions of Use at any time. We will notify you of any changes by posting the new Terms and Conditions of Use on this page.


We will inform you by email and / or a prominent notice on Our Service, before the change takes effect, and we will update the "Last Updated" date at the top of these Terms and Conditions of Use.


You are encouraged to review these Terms and Conditions of Use periodically for changes. Changes to these Terms and Conditions of Use are effective when they are posted on this page.

 

Disclaimer of Warranty

 

Our company strives to provide the best services we can, but you understand and agree that the Application service is provided "as is" and "as available", without express or implied warranty or condition of any kind. You use the services of the Application at your own risk.

 

We cannot guarantee that our Application is free of errors, virus or other problems that may affect a user.

 

You understand and accept that our Company is not responsible for any transaction or service that occurs directly between you and any of the tourist establishments that are registered in the Application.

 

In addition, the Company does not represent or guarantee or assume any responsibility for any third-party application or service, user content, or any other product or service offered by third parties through our Application or through any type of system accessed through some hyperlink, banner or some type of advertising.

 

Disclaimer of Liability

 

Our Company shall not be liable for any indirect, incidental, special, consequential, punitive, or multiple damages, nor for any loss of profits, revenue, either directly or indirectly, or for any loss of data or other intangible losses resulting from: (a) your use of the Services or inability to use the Services; (b) your access or inability to access the Services; (c) the conduct or content of other users or third parties on or through the Services; or (d) unauthorized access, use or alteration of its content.

It is the responsibility of each tourist establishment registered in our platform to provide a safe and quality service to users. Our company has no relationship or interference in the services provided by tourist establishments registered on the platform. Therefore our company shall not be liable and takes no responsibility for poor service, lost objects, theft, any type of accident or damage of any kind suffered by a user who hires the service or visits a tourist establishment registered on the platform.

 

Governing Law

 

The agreements (and any non-contractual dispute or claim related to them) established in this document are subject to the laws of the Republic of Costa Rica.

 

Privacy Policy

 

Your privacy is important to us, so you can check how we handle your information when you use our application in our Privacy Policy (https://www.improveappscr.com/explore-app-privacy-policy). We ask that you please read the Privacy Policy carefully, since by using our application, you agree with the use of data established in our policy.
